كتاب “بغية المقتصد” هو شرح لكتاب “بداية المجتهد ونهاية المقتصد” لأبي الوليد محمد بن رشد القرطبي، الشهير بابن رشد الحفيد، والذي يعدّ من أفضل ما صنّف في الخلاف الفقهي العالي، قال عنه “الذهبي” في (تاريخ الإسلام): “كتاب بداية المجتهد ونهاية المقتصد في الفقه، علّل فيه ووجّه، ولا نعلم في فنّه أنفع منه، ولا أحسن مساقًا”.
ويُعتبر من أفضل الكتب التي اشتملت على بيان أسباب الاختلاف بين العلماء في كل مسألة، فهو على صغر حجمه قد حوى أمهات مسائل الفقه؛ مبينًا مواطن الوفاق والخلاف شارحًا وجوه المذاهب المختلفة، ذاكرًا أقوال العلماء لكل مسألة من المسائل الفقهي، منبهًا على نكت الخلاف فيها مع مناقشة الآراء والأدلة، والكتاب يعد من أهم كتب الفقه المقارن.
